1    Introduction

1.1 This website is owned and provided by Match the Cash Limited

1.2    Match the Cash Limited trading as guarantormyloan.co.uk and guarantorloan.co.uk (“we”, “us” or “our”) provides a platform (the “Platform”) via www.guarantormyloan.co.uk (the “Website”) for lending and borrowing transactions conducted between our customers. We are also a consumer credit broker. We are a limited liability company registered in England and Wales under company number 08667447 and have our registered office at Acre House, 11/15 William Road, London, NW1 3ER. Match the Cash is authorised and regulated by the Financial Conduct Authority Reference No. 7118844.

1.3    These website terms and conditions (the “Terms”) apply to borrowers, lenders, guarantors, and anyone simply browsing the Website. Please read the Terms carefully. The Terms (together with the documents referred in the Terms) set out the basis on which you may make use of the Website. By using the Website, you indicate that you accept the Terms and that you agree to abide by them. If you do not agree to the Terms, you must not use the Website.

1.4    Your attention is particularly drawn to the following:

1.4.1    our Privacy and Cookies Policy, which tells you how we use your personal data and other information we collect about you, and about the cookies that we use on the Website; and

1.4.2    our Liability to you (paragraph 6).

2    Our Contract

2.1    The Terms only deal with your access to the Website.

2.2    If you register as a borrower, your borrowing activity through the Platform will be governed by the Borrower Terms and Conditions. Before entering into any Loan Agreement you should make sure that you are happy with the terms of that contract and the Borrower Terms and Conditions and take legal advice if necessary.

2.3    If you are nominated by a borrower and register as a guarantor, your activities through the Platform will be governed by the Guarantee and Indemnity. Before entering into any Guarantee and Indemnity you should make sure that you are happy with the terms of that contract and take legal advice if necessary.

2.4    If you register as a lender, your lending activity through the Platform will be governed by the Lender Terms and Conditions. Before entering into any Loan Agreement you should make sure that you are happy with the terms of that contract and the Lender Terms and Conditions and take legal advice if necessary.

2.5    In the event of any conflict or inconsistency between: 

2.5.1    the Terms; and either 

2.5.2    the Borrower Terms and Conditions, the Lender Terms and Conditions or any Loan Agreement,

the latter will prevail and take precedence.

3. Legal and Privacy Policy

3.1 The product and services featured on the Website are intended only for the residents of the United Kingdom who are 18 and over and are subject to status.

3.2 By accessing and using this website you are agreeing to our Terms of Use, Privacy Policy and Cookie Policy.

3.3 By accessing and using this Website you agree that these Terms of Use, Privacy Policy and Cookie Policy apply to you and to your access to, and use of, this Website and that you will be bound by, and comply with, these Terms of Use, Privacy Policy and Cookie Policy. If you do not agree to these Terms of Use, our Privacy Policy and Cookie Policy you must stop using this Website immediately.   

4    Accessing and using the Website

4.1    We do not guarantee that the Website, or any content on it, will always be available or be uninterrupted. Access to the Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Website without notice. We will not be liable to you if for any reason the Website is unavailable at any time or for any period.

4.2    You are responsible for ensuring that all persons who access the Website through your internet connection are aware of the Terms and other applicable terms and conditions, and that they comply with them.  

4.3    If you are browsing the Website, you may use it for your own personal use. If you have registered as a borrower or a lender on the Platform then you may use the Website for personal or commercial use, depending on your circumstances. However, we cannot guarantee that the Website will stay the same – we might change or remove it or make access to it subject to registration or charges.

4.4    Any and all personal information you provide to us via the Website may be collected, stored, processed and used in accordance with our Privacy and Cookie Policy.

4.5    The Website is directed to people residing in the United Kingdom. We do not represent that content available on or through the Website is appropriate or available in other locations. We may limit the availability of the Website or any service or product described on the Website to any person or geographic area at any time. 

4.6    You may use the Website only for lawful purposes. You must not use the Website:

4.6.1    in any way that breaches any applicable local, national or international law or regulation;

4.6.2    in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect; or

4.6.3    to knowingly transmit or introduce viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful and designed to adversely affect the operation of any computer software or hardware.

4.7    You agree not to access without authority, interfere with, damage or disrupt:

4.7.1    any part of the Website;

4.7.2    any equipment, network or server on which the Website is stored; 

4.7.3    any software used in the provision of the Website; or 

4.7.4    any equipment, network or software owned or used by any third party.

5    Intellectual Property Rights 

5.1    We are the owner or the licensee of all intellectual property rights in the Website, and in the material and documents published on it, including the Borrower Terms and Conditions, the Lender Terms and Conditions, the Loan Agreement, and the Guarantee and Indemnity. Those works are protected by copyright and other intellectual property rights. All such rights are reserved. 

5.2    You shall not obtain any right, title or interest in any of the content on the Website.

5.3    You must not modify the paper or digital copies of any materials and documents you have printed off or downloaded in any way from the Website, and you must not use any illustrations or graphics separately from any accompanying text. 

5.4    You must not use any part of the content on the Website for commercial purposes without obtaining a licence to do so from us or our licensors. 

6    Our liability to you 

6.1    Nothing in the Terms shall exclude or limit our liability for:

6.1.1    death or personal injury arising from our negligence;

6.1.2    fraud or fraudulent misrepresentation; or

6.1.3    any other liability that cannot be excluded or limited by law.

6.2    We will not be liable to any user of the Website for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

6.2.1    use of, or inability to use, the Website; or

6.2.2    use of or reliance on any content displayed on the Website. 

6.3    We provide a service and platform to facilitate access to finance. The content and material available via the Platform is for informational purposes only and should not be regarded as an offer, solicitation, invitation, advice or recommendation to buy or sell investments, securities or any other financial services or banking product. If you are unsure about whether a product is suitable you should contact an independent financial adviser.

6.4    We are not responsible to you for any:

6.4.1    loss of profits or contracts;

6.4.2    loss of revenue;

6.4.3    loss of business; 

6.4.4    loss of goodwill; 

6.4.5    business interruption; 

6.4.6    wasted management or office time; 

6.4.7    loss of anticipated savings; 

6.4.8    loss caused by circumstances outside our control; or

6.4.9    loss or damage that was caused by your breach of the Terms, whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

6.5    We will not be liable for any loss or damage caused by a virus or any other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any content on it, or on any website linked to it.

7    Linking

7.1.    The Website may include third-party advertising and links to other websites. Please note that these websites have their own privacy policies and website terms and conditions. We do not accept any responsibility or liability for these policies. Please check their privacy policies and their website terms and conditions when you visit them and before you submit any personal information to these websites. 

7.1    You may link to the homepage of the Website from another website provided you:

7.1.1    do so in a way that is fair and legal and does not damage our reputation or take advantage of it;

7.1.2    do not create frames or any other border around the Website;

7.1.3    comply with all relevant laws and regulations on the website or platform you are linking from; and

7.1.4    do not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

8    Disputes

8.1    The Terms are governed by English law. If we have a dispute regarding your use of the Website or the Terms, you and we shall submit to the exclusive jurisdiction of the English courts. However, if you are using the Website as a consumer, you will have the right to have your dispute or claim heard by the courts in your home jurisdiction.

9. Broker activities

9.1 We charge no upfront fees for our service. If a broker or lender fee is payable you will be informed of this before you proceed. Any fees will form part of your total borrowing and will be detailed within your Credit Agreement.

9.2 If we are unable to provide a guarantor loan via the platform we may with your permission pass your details to other providers that we work with. If you are successful in obtaining the credit you require through the provider we may receive commission. If you do not wish us to pass your details onto other providers, please email us at customerservice@guarantormyloan.co.uk.   

10. Telephone calls

10.1 If you call us or we call you by telephone the call may be recorded for monitoring and staff training purposes. Recordings will only be used under proper and careful supervision.
